Assistant County Attorney

Job Announcement The County Attorney’s Office is seeking an attorney with experience in complex real‑estate development and financing transactions, particularly projects involving affordable housing. The position will be located in the P5 Section and will focus primarily on transactional real‑estate and affordable housing work, while also providing support on public finance, pension systems, and procurement matters as needed. Key Responsibilities Negotiate and draft all phases of real‑estate development agreements, including acquisition, disposition, loan, and development contracts. Conduct due diligence for development projects, including title, survey, and zoning. Apply knowledge of federal affordable housing programs (e.g., housing choice vouchers, Community Development Block Grants) and landlord‑tenant/fair housing laws to client work. Prepare legal research, opinions, and briefs; provide clear written and oral advice. Manage assignments independently, meet deadlines, and collaborate with County stakeholders on a variety of legal matters. Minimum Qualifications Active member in good standing of the Virginia State Bar. Equivalent to four years of experience as a practicing attorney. Preferred Qualifications Substantial experience in complex real‑estate and affordable housing transactional matters. Familiarity with fair housing issues and public financing. Experience in local government law. Underfill Requirements Position may be filled at the Assistant County Attorney III level (Grade L03). Requires at least one year of experience as a practicing attorney, active Virginia State Bar membership, and successful completion of a 12‑month probationary period. Eligible for promotion to Assistant County Attorney V after meeting competency standards. Underfill candidates must meet the Assistant County Attorney V minimum qualifications within one year after the closing date of May 1, 2027. Certificates and Licenses Required License to practice law in the state of Virginia. Necessary Special Requirements Criminal background check completed to satisfaction of the employer. Statement of Economic Interest form completed prior to starting. Prohibition of private practice except for approved pro‑bono programs. Physical Requirements Travel to various locations within Fairfax County, Northern Virginia, and other areas. Use of computer for data entry, access, and retrieval. Effective verbal and written communication skills. Ability to perform duties with reasonable accommodations when required.
