Asst County Attorney V - Affordable Housing Development and Finance

Role Overview The County Attorney's Office seeks an attorney with substantial experience in complex real estate development and financing transactions, specifically affordable housing projects. The position is within the P5 Section and will focus primarily on transactional real estate and affordable housing work, with occasional involvement in public finance, pension systems, and procurement matters. Responsibilities Negotiate and draft acquisition, disposition, loan, and development agreements for real estate projects. Conduct due diligence including title, survey, and zoning review. Support federal affordable housing initiatives such as housing choice vouchers and Community Development Block Grants. Advise on landlord‑tenant laws and fair housing requirements. Perform legal research, authorship of opinions, and public speaking as needed. Manage deadlines and provide independent legal support to County entities and boards. Minimum Qualifications Active, good‑standing Virginia State Bar member. Four years of experience as a practicing attorney or equivalent education and experience. Underfill Requirements Position may be filled at Assistant County Attorney III level, requiring active Virginia State Bar membership and one year of experience. Upon successful 12‑month probation and four years total experience, eligibility for non‑competitive appointment to Assistant County Attorney V. Underfill candidates must meet Assistant County Attorney V qualifications within one year of the closing date May 1, 2027. Certificates and Licenses Required License to practice law in Virginia. Special Requirements Complete a criminal background check. Submit a Statement of Economic Interest form before starting. Position is full‑time within the Fairfax County Merit System; private practice of law is prohibited except pro‑bono services in approved programs. Preferred Qualifications Demonstrated experience in complex real estate and affordable housing transactional matters, public financing, and local government law. Physical Requirements Travel within Fairfax County and surrounding areas for meetings, conferences, and hearings. Operate computer for data input and retrieval. Communicate effectively with colleagues and clients. Perform duties with or without reasonable accommodations. Selection Procedure Panel interview possibly including a practical exercise.
