Trade Secrets & Commercial Litigation Associate

Location: Miami, Florida

Experience: Ideally 3–5 years

Base Salary: $175,000–$225,000, commensurate with experience

A highly regarded Miami litigation boutique is seeking an associate who wants to develop a meaningful specialty in trade secret and non-compete litigation .

\n

\n

The firm represents both plaintiffs and defendants in sophisticated disputes involving proprietary information, employee mobility, unfair competition, and related business issues. Prior trade secrets experience is not required. The successful candidate must, however, be genuinely interested in how companies develop, use, and protect confidential information—and excited to make this area a central focus of their practice.

The Work

\n

Trade secrets litigation is fast-moving, investigative, and strategically challenging. Matters often involve analyzing forensic IT evidence to determine what information was taken, when it was accessed, and how it may have been used. Each case requires the legal team to learn a new company, technology, or industry quickly.

\n

\n

Many engagements begin with an emergency request for injunctive relief. A matter can progress from the initial client call to an evidentiary hearing within a matter of weeks.

\n

\n

The associate will work closely with a senior partner and will have opportunities to:

\n

\n
• Seek and defend against temporary restraining orders and preliminary injunctions
\n
• Develop case strategy from initial investigation through trial
\n
• Analyze forensic IT evidence
\n
• Work directly with forensic technology and subject-matter experts
\n
• Draft pleadings, motions, and substantive briefs
\n
• Take and defend depositions
\n
• Argue motions and participate in evidentiary hearings
\n
• Prepare witnesses and experts
\n
• Participate meaningfully in trials
\n
• Handle additional complex commercial litigation matters
\n

Qualifications

\n

• Ideally three to five years of litigation experience, although candidates outside that range may be considered
\n
• Excellent research, analytical, and legal-writing skills
\n
• Strong interest in oral advocacy and trial work
\n
• Ability to work effectively under the compressed timelines common in injunction proceedings
\n
• Intellectual curiosity and an interest in learning how different businesses operate
\n
• Sound judgment, initiative, and close attention to detail
\n
• Membership in the Florida Bar or willingness to sit for the February 2027 Florida Bar examination
\n

Prior trade secret or non-compete experience is helpful but not required.

Compensation

\n

The anticipated base salary is $175,000–$225,000 , depending on experience, credentials, and demonstrated litigation skills. Additional information regarding the firm’s compensation and benefits package will be provided during the interview process.
