CLASSIFICATION TITLE: ASSISTANT DISTRICT ATTORNEY II

PURPOSE OF CLASSIFICATION

The purpose of this classification is to evaluate criminal cases that come into the office and to represent the state in the resolution of the case via dismissal, plea negotiations, or trial.

ESSENTIAL FUNCTIONS

Meet regularly with the Chief Assistant District Attorney and keep him advised of the activities of each courtroom. Coordinate with the Chief regarding the scheduling of grand jury assignments for Assistant District Attorneys so as not to conflict with courtroom scheduling. Have an advanced working knowledge of the general facts and legal issues on the Motions and Trial calendars in each courtroom. Be present in the courtroom or office during the Motions and Trial calendars to provide assistance to the Assistant District Attorney. In the event of the absence of both the District Attorney and the Chief Assistant District Attorney, be present in the courthouse or be immediately available. Supervise Assistant District Attorneys in the courtroom to ensure orderly case management. Supervise, direct, and evaluate assigned staff, process employee concerns, direct work, counsel, and complete employee performance appraisals. Draft accusations and indictments; evaluate and research potential defenses; dismiss cases that are not prosecutable. Read cases submitted by investigator; read police reports; determine whether further investigation is needed; approve or return cases for more work; research alternative crimes; read and research case law. Present cases to grand jury; question witnesses; answer juror questions; determine appropriate sentence recommendations; call arraignment calendars; attend pre‑trial conferences with judge and defense attorneys. Subpoena appropriate witnesses for motions; research and argue all pre‑trial and post‑trial motions; file motions in appropriate time frame prior to trial. Comply with discovery requirements by copying and mailing documents. Work with trial team investigators to coordinate witnesses and evidence for trials; gather and label evidence. Argue appellate motions in the Court of Appeals and Georgia Supreme Court and negotiate pleas to dispose of cases as necessary. Interview witnesses, victims, experts, and police; question potential jurors and select jury; arrange interpreter services for witnesses when necessary. Develop trial strategy for each case; organize opening and closing arguments; present evidence at trial; consult with supervisors about trial strategy. Fill out jury cards; read appellate briefs and case transcripts; research and write responses to briefs. Represent the state in probation revocation hearings; respond to parole notices. Handle telephone calls from attorneys, witnesses, and concerned citizens and speak to reporters on various cases. Determine appropriate bond amounts. Attend meetings and maintain continuing education requirements.

ADDITIONAL FUNCTIONS

Through leadership and example, influence the Assistant District Attorneys in a positive and efficient manner by promoting consistency in sentencing recommendations, completing discovery in a timely manner, approving grand jury cases promptly, assisting with duty officer calls and other forms of advice, establishing a good working relationship with other staff members, and maintaining productive and positive morale among the legal staff. Perform other related duties as required.

MINIMUM QUALIFICATIONS

Juris Doctorate; supplemented by three (3) years of prosecution experience or comparable felony trial experience with demonstrated effective and progressively proficient work as an Attorney; or any equivalent combination of education, training, and experience which provides the requisite knowledge, skills, and abilities for this job. Must possess and maintain valid membership in the Georgia Bar Association, Court of Appeals of the State of Georgia, and Supreme Court of the State of Georgia.

Physical Ability: Tasks require the ability to exert light physical effort in sedentary to light work, but may involve some lifting, carrying, pushing and/or pulling of objects and materials of light weight (5-10 pounds). Tasks may involve extended periods of time at a keyboard or workstation. Sensory Requirements: Some tasks require the ability to perceive and discriminate sounds and visual cues or signals. Some tasks require the ability to communicate orally. Environmental Factors: Essential functions are regularly performed without exposure to adverse environmental conditions.
