Pre-Litigation Attorney

The Pre-Litigation Attorney is part of a team of attorneys with hands-on management of personal injury cases, including but not limited to medical malpractice, automobile accidents, and premises liability matters. This role leads and provides oversight for a staff of case managers, negotiators, and/or paralegals while guiding cases toward successful resolution.
Supervisory Responsibilities

• Manage, motivate, and lead a team of legal professionals, including case managers and negotiators.
• Ensure accuracy, compliance, and exceptional client service across the team.

Key Responsibilities
1. Case Management

• Manage a high-volume personal injury pre-litigation caseload through resolution with the support of the legal team.
• Build strong client cases by ensuring all injuries, damages, and losses are thoroughly documented and presented to maximize recovery.
• Analyze legal and medical records to determine liability, damages, and insurance coverage.
• Conduct legal research and provide guidance on personal injury matters.
• Communicate effectively with clients, insurance carriers, and opposing counsel.
• Resolve cases through negotiation, mediation, arbitration, and settlement.
• Conduct client, witness, provider, and expert interviews, as well as depositions and case-related calls.
• Perform regular case reviews to monitor progress and support timely resolution.
• Evaluate cases for litigation referral and identify facts critical to negotiations or future litigation strategy.

2. Team Leadership & Department Management

• Provide coaching, mentoring, and constructive feedback to team members.
• Oversee daily operations of the Pre-Litigation Department and ensure cases progress appropriately.
• Collaborate with internal teams regarding settlement disbursements, subrogation matters, liens, and third-party interests.
• Identify opportunities to improve department processes, workflows, and efficiencies.

3. Client & Community Engagement

• Foster professional relationships within the community to support client service initiatives and professional networking efforts.
• Ensure a high level of client satisfaction through proactive communication and timely follow-up.
• Conduct demand package reviews with clients, providing case updates and discussing negotiation strategies.

4. Compliance & Legal Research

• Conduct legal research and analysis related to personal injury laws, regulations, and legal precedent.
• Stay informed on developments and changes within personal injury law and related practice areas.

• Bilingual Spanish proficiency preferred.

• Proven leadership experience supervising and developing legal support staff.
• Experience utilizing case management systems (CMS).
• Strong technical proficiency with legal databases, software platforms, portals, and related technology.
• Professional, empathetic, and client-focused demeanor with the ability to de-escalate sensitive situations.
• Demonstrated professionalism, integrity, and ethical judgment.

Education & Experience Requirements

• Juris Doctor (J.D.) degree from an accredited law school.
• Active membership in the State Bar of North Carolina in good standing, or ability to obtain admission within ninety (90) days of employment.
• Minimum of 3-5 years of settlement negotiation and case resolution experience.
• At least three (3) years of leadership experience managing and mentoring legal staff.
• Minimum of three (3) years of pre-litigation experience, with personal injury experience strongly preferred.
