Position Overview
We are seeking a motivated Real Estate Litigation Attorney to join our firms litigation group. The attorney will manage a diverse caseload focused on real estate disputes including quiet title actions, commercial litigation, land use and zoning matters, entitlement disputes, and eminent domain cases. The role requires effective advocacy in state and federal court, drafting pleadings and motions, conducting discovery, and advising clients on risk and strategy. Admission to the State Bar of Arizona and experience with real estate matters are essential.

Key Responsibilities

• Manage a full docket of real estate litigation matters, including quiet title, boundary disputes, and commercial landlord/tenant cases.
• Draft and file pleadings, motions, briefs, settlement agreements, and other litigation documents for state and federal courts.
• Conduct factual and legal research, prepare memoranda, and develop case strategy in coordination with partners and clients.
• Lead discovery activities including written discovery, depositions, subpoenas, and document review and production.
• Represent clients at hearings, mediations, arbitrations, and trials; present oral arguments and examine witnesses.
• Advise clients on land use, zoning, and entitlement issues; collaborate with land-use planners and municipal counsel where necessary.
• Handle eminent domain matters, including valuation analysis, negotiating just compensation, and litigation when needed.
• Work closely with transactional real estate counsel to identify and mitigate litigation risks during acquisitions, dispositions, and development.
• Maintain regular client communication, provide status updates, and develop pragmatic, cost-effective legal solutions.

Qualifications

• Juris Doctor (J.D.) from an accredited law school and active membership in the State Bar of Arizona.
• 3+ years of litigation experience with a focus on real estate matters; courtroom and trial experience preferred.
• Demonstrated experience with commercial real estate litigation, land use, zoning, and entitlement issues.
• Experience handling eminent domain matters and familiarity with valuation and condemnation procedures.
• Strong legal research, writing, and advocacy skills; ability to draft persuasive pleadings and appellate briefs.
• Excellent negotiation, interpersonal, and client-management skills; able to work independently and as part of a team.
• Proven ability to manage heavy caseloads, prioritize tasks, and meet deadlines in a fast-paced environment.
• Familiarity with local Arizona real estate laws, municipal procedures, and court rules.
