Position Description

This Non-civil service position located within the Department of Law will perform legal work for the Metropolitan Government and provide counsel to the Choose How You Move (CHYM) Office), specifically related to infrastructure project delivery. Typical issues include compliance with municipal, state, and federal law specific to transit, infrastructure, capital project delivery, right-of-way acquisition, and contracts and procurement.

CHYM, approved by 66% of voters in 2024, is Mayor O'Connell's transportation improvement program and the largest capital program in geographic scope and scale to be undertaken in Nashville's history. Implementation of the $3.1 billion in CHYM capital projects requires extensive collaboration among multiple Metro departments, project managers, and vendors; coordination of $111 million worth of annual operating expenditures; and robust engagement with neighbors. CHYM will transform how people move around the city for decades to follow.

CHYM includes installation of smart signals at nearly 600 intersections. It adds 24/7/365 transit service and builds 54 miles of high-capacity transit with more frequent, reliable, and accessible service. It builds 86 miles of sidewalks to ensure Nashville completes the WalkNBike Nashville priority sidewalk network and connects our busiest neighborhoods to major transit routes. The program makes safety improvements on 78 miles of the Vision Zero High-Injury Network, creating safer streets for pedestrians, bicyclists, drivers, and transit users alike.

Typical Duties

• Represents and advises Choose How You Move Chief Program Office to support the implementation of Choose How You Move across Metro Nashville.

• Interacts and collaborates with multiple partners in implementation, both internal and external to Metro government.

• Assists in right-of-way planning and acquisition, including representing Metro in condemnation actions if appropriate.

• Prepares and reviews contracts; grants; requests for proposals, requests for qualifications and other procurement documents; memorandums of understanding and agreement; documents related to the design, engineering, and construction of infrastructure projects; documents related to right-of-way acquisition; and other legal documents.

• Attends meetings concerning legal matters.

• Performs legal research to support programmatic goals and policy implementation in coordination with the Chief Program Officer.

• Gives oral or written opinions on a variety of legal issues.

• Drafts and analyzes legislation at the local, state, and federal level.

• Assists with special projects and other functions, as specified and directed by the Deputy Law Director.

Minimum Qualifications

Doctor of Jurisprudence and a minimum of two (2) years of relevant legal experience.

LICENSES REQUIRED:

License to practice Law in the State of Tennessee or permitted to practice law pursuant to applicable rules of the Tennessee Supreme Court.

Note: Per Metro Ordinance No. SO94-1078. All employees of the Metropolitan Government shall be residents of the State of Tennessee or become residents of the state within six (6) months of employment as a prerequisite to employment with the Metropolitan Government.

Preferred Experience, Knowledge, Skills, and Abilities

• Knowledge of legal principles related to infrastructure project delivery

• Skill analyzing and applying legal principles and precedents to specific problems

• Skill presenting statements of fact, law, and argument clearly and logically

• Familiarity with Metro Government processes
