Summary The Division of Enforcement, Trial Unit is seeking a Supervisory Trial Attorney(Supervisory Trial Counsel). As a Supervisory Trial Counsel, you will serve as a senior trial attorney and manager, providing program direction and technical leadership in areas of litigation handled by the Commission. Duties In this role as a Supervisory Trial Counsel, you will be responsible for: Participating with investigative and Trial Unit staff to assess litigation risks and recommend enforcement actions. Provides advice during investigations on litigation-related issues. Supervising trial attorneys and litigation in a variety of cases, including difficult and complex matters that can result in new legal precedent. These cases often are highly sensitive, high-profile, and require innovative litigation and trial techniques. Supervising, reviewing, and editing all case-related legal papers and briefs filed in assigned litigation cases, including in civil actions and administrative proceedings. Supervising oral arguments, hearings, and trials in court and attends court proceedings, as warranted. Providing effective leadership in assessing settlements. Conducting litigation in district court and administrative proceedings, including preparing and filing briefs and other legal papers, arguing motions, taking depositions, and trying cases. Representing the SEC in dealings with state and federal regulatory and enforcement counterparts. Requirements Conditions of employment CITIZENSHIP: You must be a US Citizen. PERMANENT CHANGE OF STATION (PCS): Moving/Relocation expenses are not authorized. TRIAL PERIOD: Consistent with 5 U.S.C. § 7511, you will be required to serve a two-year trial period (one year for preference eligible veterans) if the position to which you have applied is not the same or similar to your current position of record. SUPERVISORY TRIAL PERIOD: This appointment may require completion of a two year supervisory/managerial trial period. You must possess a J.D. or LL.B Degree and you must be an active member of the bar in good standing. The selectee is required to report to the duty station(s) listed. Qualifications Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional, philanthropic, religious, spiritual, community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. BASIC REQUIREMENT: All applicants must possess the following J.D. or LL.B. degree --AND-- Active membership of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico. (Note: proof of bar membership will be required before entry on duty. MINIMUM QUALIFICATION REQUIREMENT: In addition to meeting the basic requirement, applicants must also meet the minimum qualification requirement. SK-17: Applicant must have one year of specialized experience equivalent to the GS/SK-14/15 level. Specialized experience includes: Litigating complex civil or criminal cases in Federal Court or Administrative Proceedings. Critical Thinking - Considers a variety of factors, general and subject matter-specific, when making decisions and determining next steps in a case. Legal Analysis - Utilizes expert legal knowledge to apply relevant law to the facts of each case. Developing and Managing Others - Ability to recruit, develop and manage the workforce to meet organizational goals, with little or no guidance. Education You MUST provide transcripts or other documentation to support your educational claims.
