Brief Position Summary Performs advanced (senior level) investigative and employee‑relations work for the Texas Military Department (TMD). Work involves receiving, reviewing, and evaluating employee grievances submitted under the guidelines of the State Employee Policies & Procedures Manual (SEPPM). Conducts impartial investigations, gathers evidence, interviews witnesses, evaluates facts, prepares written findings, and provides recommendations when requested. Reports to the HR Director and works under minimal supervision with considerable latitude for the use of initiative and independent judgment. Work Hours Monday - Friday, 8-hour days, 40 hours/week Essential Job Functions and Responsibilities Serves as the primary intake point for all grievances submitted by State Employees. Reviews grievances for completeness and compliance as outlined within the State Employee Policies & Procedures Manual (SEPPM). Tracks all statutory and policy‑based deadlines, including the 21‑day submission timeline and timelines for dismissal/termination grievances. Communicates with grievant regarding corrections, resubmittals, or procedural requirements. Maintains strict confidentiality consistent with policy and law. Conducts impartial investigations assigned by the State Human Resources Director or Director of State Administration. Performs investigations outside the grievant's supervisory chain to maintain neutrality when required. Gathers and evaluates evidence including interviews, affidavits, personnel records, emails, and other documentation. Develops and executes investigative plans; documents all investigative steps. Completes investigations within the 30‑day guideline or provides updates when delays occur. Ensures compliance with anti‑retaliation and anti‑false‑information provisions. Prepares formal investigative reports summarizing complaint elements, adverse effects, investigative results, and factual conclusions. Presents findings to designated decision makers and provides recommendations when requested. Ensures written Step Two decisions comply with Chapter 6 of the SPPEM procedural requirements. Provides guidance to employees and supervisors regarding grievance procedures and dispute‑resolution options. Participates in mediation or informal resolution efforts. Reviews dismissal recommendations and assists the HR Director in determining whether grievances meet policy criteria. Maintains secure grievance files and processes document requests consistent with redaction rules, confidentiality, and access as applicable within policy. Updates and maintains OSA HR grievance log. Ensures investigative practices comply with federal and state employment laws. Conducts training for management on grievance handling, anti‑retaliation, documentation, and conflict resolution. Coordinates with Legal, Inspector General, and Judge Advocate General offices on complex or high‑risk cases. Collaborates and consults with TMD Ombudsman Office and federal EEO Office regarding matters related to TMD’s equal opportunity policies and complaints. Supports broader HR operations when investigative expertise is needed. Develops investigative techniques and/or policies and procedures for conducting investigations. Serves as a liaison with external entities. Provides support across various HR functions as needed to ensure smooth departmental operations. Attends work regularly and observes approved work hours in accordance with agency state employee policies & procedures handbook. May occasionally work evenings, weekends or holidays. Performs related work as assigned. Minimum Qualifications Education: Graduation from an accredited four‑year college or university is required. Preferred Education: Graduate degree in Human Resources, Criminal Justice, Public Administration, or a related field is preferred. Experience: Four years of experience in employee relations, investigations, complaint resolution, or similar work. Experience using Microsoft Office applications including Word, PowerPoint, and Excel is required. Preferred Experience: Experience conducting formal investigations, interviewing subjects/witnesses, evaluating evidence, and preparing written findings. Experience interpreting HR policies and employment laws. Registration, Certification or Licensure Valid driver’s license is required. The ability to obtain a Texas Driver’s License will be required within first 30 days of employment. A satisfactory driving record is required for driving state or federal vehicles to conduct agency business. Certification as Certified Mediator is preferred. Other Requirements Background Investigation. Selected candidate must pass federal security background investigation and be able to obtain a Common Access Card (CAC). The process includes a National Agency Check and Inquiry (NACI) and fingerprinting. New employees must complete and sign the Office of Personnel Management (OPM) Form SF85. Completed forms are submitted to the OPM for the background investigations. Eligibility to Work in the U.S. The Immigration Reform and Control Act of 1986 requires all new employees to present proof of eligibility to work in the United States within three days of being hired. The Texas Military Department participates in E‑Verify and will provide the Social Security Administration (SSA) and, if necessary, the Department of Homeland Security (DHS), with information from each new employee’s Form I‑9 to confirm work authorization. All offers of employment are contingent upon the candidate having and maintaining legal authorization to work in the United States. Failure to present such authorization within the time specified by the U.S. Department of Labor will result in the offer being rescinded. Sponsorship. Candidates must be eligible to work in the United States without requiring sponsorship. Upon hire with the State of Texas, males between the ages of 18 through 25 must provide proof of registration or exemption with the Selective Service. Knowledge, Skills and Abilities Knowledge of: grievance procedures and timelines; investigative techniques, evidence collection, and interview methodology; and federal and state employment laws, including EEO, ADA/ADAAA, and anti‑retaliation provisions. Skills in: conducting neutral, thorough, and timely investigations; interviewing employees and evaluating testimonial and documentary evidence; preparing clear, concise, and objective investigative reports; managing multiple cases simultaneously; the operation of technical equipment and detection devices; using a computer and applicable software; mediation and negotiation techniques. Ability to: maintain confidentiality and neutrality; apply policies objectively and consistently; conduct investigations; interpret and apply laws and regulations; work with local, state, and federal agencies; conduct interviews and gather facts; evaluate findings; prepare reports; communicate effectively with employees at all organizational levels; and meet deadlines and manage sensitive issues with discretion. Physical/Working Conditions Work is generally performed inside a climate‑controlled space, and incumbent is exposed to normal office temperatures and noise. Some work is performed in environments that are not climate‑controlled and in outside conditions, which may include working in the heat, rain, wind, and cold during events. Work involves standing, walking, cleaning, painting, and working with computers and related equipment. May lift, carry, move, and/or set up equipment and heavy objects. Documentation must be provided before a Military Employment Preference can be granted.
