Workers' Compensation Attorney (Defense)

Position Overview
We are seeking a skilled Workers' Compensation Attorney to defend employers and insurance carriers in workers' compensation claims. The attorney will manage a substantial litigation caseload across all stages of claim handling from initial investigation and pleadings through hearing, trial and appeal while providing strategic legal advice to clients and coordinating with claims professionals, medical experts, and outside counsel as needed. The ideal candidate has strong defense and litigation experience in workers' compensation matters and is committed to efficient case management and favorable client outcomes.

Key Responsibilities
  • Manage an active caseload of workers' compensation claims for employers and carriers, including intake, investigation, and case assessment
  • Develop and implement defense strategies tailored to individual claims, focusing on dispute resolution and cost containment
  • Draft and file pleadings, motions, responses, and other court documents in accordance with applicable rules and deadlines
  • Conduct and respond to discovery, prepare for and take depositions, and handle evidentiary hearings and trials
  • Negotiate settlements with claimants and opposing counsel, documenting agreements and obtaining required approvals
  • Coordinate with claims adjusters, medical providers, vocational experts, and outside experts to develop defense positions and obtain necessary evidence
  • Advise clients on coverage, risk exposure, litigation strategy, and potential settlement outcomes
  • Maintain accurate case files, billing records, and client communications in firm/insurer matter management systems
  • Prepare and manage appeals as necessary, including drafting appellate briefs and presenting oral argument where required
  • Provide training or updates to claims teams and corporate clients on changes in workers' compensation laws and best practices

Qualifications

  • Juris Doctor (J.D.) from an accredited law school and admission to practice in the state (active bar membership required)
  • Minimum of 3-5 years of hands-on workers' compensation defense litigation experience; trial experience preferred
  • Demonstrated litigation skills, including motion practice, depositions, hearing and trial advocacy
  • Strong knowledge of state workers' compensation statutes, rules, and case law
  • Excellent written and oral communication skills with the ability to explain legal issues clearly to non-lawyers
  • Proven ability to manage a heavy caseload, prioritize tasks, and meet strict deadlines
  • Experience negotiating settlements and counseling clients on strategy and exposure
  • Proficiency with case management software, electronic filing systems, and Microsoft Office
  • Willingness to travel to hearings, trials, and client sites as necessary
  • Professionalism, sound judgment, and a client-service oriented approach
