Position: Bankruptcy Specialist I

Department: Collections

Reports to: Collections Manager

FLSA : Non-Exempt Grade 9

SUMMARY

Responsible for managing accounts in the bankruptcy process to minimize losses, control legal expense and preserve the Credit Union’s interests. Performs all duties in accordance with the Credit Union’s guidelines, applicable federal, state and local regulations.

SUPERVISORY RESPONSIBILITIES

None.

ESSENTIAL FUNCTIONS

• Codes all Bankruptcy accounts with the appropriate Bankruptcy Warnings.
• Ensures correct credit reporting to all applicable bureaus in accordance with all regulations.
• Audits all documents associated with the Bankruptcy, including but not limited to: Motion for Relief, Agreed Orders, Proof of Claims, Cram Downs and Notice of Defaults.
• Processes all trustee checks on bankrupt accounts received into Collections Department.
• Recommends Bankruptcy accounts to Collections Management for charge off.
• Responsible to answers all credit disputes related to Bankruptcy.
• Perform analysis of the debt and case to determine if any action is needed.
• File maintains accounts when discharged from Bankruptcy.
• Assist with payments on reaffirmed accounts.
• Initiates any objections via counsel with regards to bankruptcy plan.
• File signed reaffirmation agreements with courts electronically.
• Handle all bankruptcy related correspondence, phone calls, emails and tasks promptly to ensure regulatory compliance.
• Responsible for recommending vehicles for repossession that are surrendered in Bankruptcy.
• Monitors Chapter 13 payments reschedule accounts and apply disbursements accordingly.
• Responsible for follow up on all accounts on a monthly basis for proper disbursement of payments from bankruptcy trustee.
• Monitors all Bankruptcy Queues for appropriate course of action.
• Responsible for collection of reaffirmed debts still coded as Bankruptcy.
• Follows procedures for account reconciliation relating to account regaling.
• Stops statements and delinquent notices on bankrupt accounts.
• Responsible for compliance with all Federal regulations including Bank Secrecy Act (BSA) and Office of Foreign Assets Control (OFAC).

Other Duties and Responsibilities:

• Attends bankruptcy court as needed.
• Keeps up to date on current Bankruptcy and Collection Laws.
• If demand presents, may be required to assist with Collection calls.
• Performs other duties as required by management.

Education:

• A high school education or GED.

Experience and Other Requirements:

• Accuracy and attention to detail required.
• One year to three years of similar or related experience.
• Must have a basic working knowledge of bankruptcy laws in order to handle calls.
• Must be able to work well under stress and be able to meet deadlines.
• Must be able to handle member problems in a professional manner.
• Must possess an outgoing personality with a helpful attitude and a well-developed telephone service technique aimed at exceptional member service.
• Must maintain confidentiality and dependability at all times.
• Must possess exceptional communication skills, verbal and written.

Computer Skills:

• Extensive use of personal PC required.
• Must be proficient in Microsoft Word, Excel, as well as use of internet and e-mail.
