Staff Attorney #2209 - County Attorney's Office - Unassigned Division

Under general supervision, provides legal representation and counsel to County departments, elected officials, and agencies. Handles a variety of legal matters, including civil litigation, contracts, employment law, and local government law. This is a Fair Labor Standards Act Defined Exempt Position . Exempt positions are excluded from minimum wage, overtime regulations, and other rights and protections afforded nonexempt workers. The employee in this position is paid a salary rather than an hourly wage. FLSA does not limit the amount of work time an employer may require or expect from any exempt employee, on any schedule. Hamilton County Government expects an employee in this position to complete the work assigned regardless of the number of hours involved in completing the tasks assigned.

ESSENTIAL FUNCTIONS

Provide legal advice and representation to county officials, departments, and boards on matters of law, policy, and governance. Represent Hamilton County in civil litigation, administrative proceedings, and appeals. Draft, review, and negotiate contracts, ordinances, resolutions, and other legal documents. Provide legal oversight on a wide range of transactional matters, including property acquisitions, public-private partnerships, procurement, and financial agreements. Review, negotiate, and advise on contractual obligations, risk assessment, and compliance with applicable laws and policies. Conduct legal research and prepare legal opinions on matters affecting county government. Ensure compliance with federal, state, and local laws and regulations affecting county operations. Prosecute or defend lawsuits on behalf of the county, including claims involving employment disputes, land use, and complex civil rights issues pursuant to 42 U.S.C. § 1983. Participate in public meetings and provide legal guidance to the County Commission and other governing bodies. Work collaboratively with other attorneys and staff within the County Attorney’s Office. Perform other related duties as assigned. Knowledge of Federal, State and County laws, regulations, and statutes that affect County government. Knowledge of County organizations, boards, elected officials, and departments in order to defend. Knowledge of State and Federal legislative process. Skill in transactional legal matters, including procurement and public financing. Skill in litigation defense – preferably in state and local courts in Hamilton County. Skill in legal research and writing. Skill in establishing and maintaining effective working relationships. Skill communicating complex legal issues in simple terms. Skill in legal research, writing, and oral advocacy skills. Ability to handle multiple cases and projects simultaneously in a fast-paced environment. Ability to work effectively with government officials, agencies, and the public.

ADDITIONAL REQUIREMENTS

Prior to operating a County-owned vehicle, all employees are required to complete the HC Defensive Driving course and/or an Emergency Vehicle Operations Course (EVOC) provided at the department level. A Juris Doctor (J.D.) degree from an accredited law school is required. Must be licensed to practice law in the State of Tennessee and be in good standing with the Tennessee Bar at the time of application and at the time of hire. Must possess a minimum of two (2) years of direct work experience in civil litigation, administrative, or related legal fields. A valid driver’s license is required.

PREFERRED QUALIFICATIONS

Trial experience within the Hamilton County, the Eastern District of Tennessee, and/or local jurisdictions is preferred. Strong knowledge of municipal, administrative, contract, and employment law is preferred. Experience in contract negotiation, drafting, and review for governmental entities or similar organizations is preferred. Experience in compliance matters, including HIPAA, ADA, EEO, and relevant state laws is preferred.

PHYSICAL REQUIREMENTS

Work requires a minimum to moderate amount of physical effort with intermittent typing, sitting, standing, walking, and driving. This position may require the occasional or regular lifting and carrying of up to twenty-five (25) pounds.
