Prosecuting Attorney, Level 2

TLC is the agency responsible for regulating New York City’s taxicab and for-hire vehicle industry. With approximately 180,000 licensed drivers and 115,000 vehicles, including the iconic yellow taxi, TLC is in a new era of dignity, accountability, and collaboration across the sector. The Prosecution Division investigates and prosecutes all summonses issued by TLC, amounting to over 100,000 summonses each year. Under the supervision of senior supervising attorneys, the Prosecuting Attorney II will assist all Prosecution Units with summons processing focusing on Port Authority summonses, appear on all summonses issued in connection with Port Authority’s airport enforcement of regulations prohibiting impermissible solicitation, prepare case files associated with summonses issued by the Port Authority Police, prepare officer testimony when necessary, and assist supervising attorneys assigned to the Port Authority cases. The role also includes providing continuous training and guidance to officers on issuing summonses with sufficient narratives to establish rule violations, prosecutor training and intern supervision, assisting the managing attorney in other TLC prosecution matters, prosecuting TLC summonses at OATH Hearings Division, reviewing and editing charging documents, overseeing the preparation of evidence and witnesses for introduction at administrative hearings, overseeing the division’s processing and issuance of stipulations based upon individual and/or batch settlement requests, and conducting micro trainings as required. Responsibilities Assist all prosecution units with summons processing focusing on Port Authority summonses. Prepare case files associated with summonses issued by the Port Authority Police and prepare officer testimony when necessary. Assist supervising attorneys assigned to the Port Authority cases. Provide continuous training and guidance to officers regarding issuing summonses with sufficient narratives to establish rule violations. Provide prosecutor training and intern supervision. Assist the managing attorney in other TLC prosecution matters and prosecute TLC summonses at OATH Hearings Division. Review and edit charging documents prepared by prosecuting attorneys. Oversee the preparation of evidence and witnesses for introduction at administrative hearings. Oversee the division’s processing and issuance of stipulations based upon individual and/or batch settlement requests. Conduct micro trainings as required. Qualifications Admission to the New York State Bar. One year of satisfactory United States legal experience subsequent to admission to any state bar; or Six months of satisfactory service as an Agency Attorney Interne (30086). Maintain membership in the New York State Bar in good standing for the duration of employment. Additional experience requirements: To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience; assignment to AL III requires two years of experience at Assignment Levels I and/or II or three years of comparable legal experience. Salary: New Hire Rate $83,000; After two (2) years of city employment: $95,450. Location: Long Island City, NY.
