Toxic Tort Trial Attorney — Federal Defense

Job Overview Trial Attorney position located in the Department of Justice, Civil Division, Torts Branch, Camp Lejeune Unit. The unit defends the United States in the largest mass toxic tort litigation under the Camp Lejeune Justice Act of 2022 (CLJA), Pub. L. No. 117-168, 804, 136 Stat. 1802, 1802-04 (2022). This litigation involves complex fact- and expert-based discovery, scientific and medical experts, federal agency interaction, robust motion practice, oral advocacy, settlement negotiations, trials, and appellate matters. The unit also cooperates with the DOJ Civil Appellate Section and the Department of the Navy on administrative claims and settlement matters. The Camp Lejeune team provides litigation training and attends educational programs for Federal employees. This is not a remote position; the incumbent will work in person five days a week. Responsibilities Prepare for and conduct hearings, settlement negotiations, and trials of complex cases, including drafting pleadings, motions, briefs, and other documents based on legal and factual research. Participate in pretrial and prehearing conferences; conduct trials or present oral arguments in federal courts, state courts, and administrative proceedings. Provide advice to junior trial attorneys; handle appellate litigation as necessary. Review and analyze facts and develop evidence, often in cases where legal principles are not clearly established or are novel. Confere with the Chief to identify departmental policy, apply government case theory, determine applicable legal principles, select and examine witnesses, and plan trial strategy. Represent the United States and individual clients in direct negotiations and discussions with attorneys for private litigants. Participate in settlement formulation with opposing counsel in matters having far‑reaching legal consequences. Recommend proposed legislative changes and advise on legal and policy questions related to statutes administered by the Office. Report case status and legal matters to the Chief, and maintain close contact with Division officials, Department employees, other government agencies, and the public. Respond to inquiries from the White House, Congress, federal departments, state and local authorities, and private individuals on statutory responsibilities. Perform special legal and administrative projects requiring broad experience and sound judgment. Carry out additional job‑related duties as assigned and receive general instructions from the Assistant Director and Unit Chief. Consult with the Assistant Director and Unit Chief regarding issues affecting policy, procedure, or case action. Requirements U.S. Citizen or National. Successful completion of a background investigation that includes drug testing. Compliance with selective‑service registration or exemption for applicable male applicants born after 12/31/1959. Complete a 2‑year trial period (see Trial Period Statement). Possess or be authorized to obtain and maintain a security clearance as required. Pass a drug‑free workplace screening prior to final appointment. Disclose financial information in accordance with DOJ and Federal ethics guidelines. Trial Period Statement As a condition of employment, the incumbent is required to serve a 2‑year trial period while the agency evaluates fitness and public‑interest advancement. Evaluation criteria include performance, conduct, agency needs, advancement of organizational goals, and efficiency of the Federal service. After completion, employment will terminate unless certification of continued employment is granted in writing. Qualifications J.D. or equivalent degree, licensed and authorized to practice as an attorney under the laws of any U.S. state, territory, or the District of Columbia, and an active member of the bar in good standing. For GS‑11: up to 1 year of post‑J.D. legal experience. For GS‑12: minimum 1 year of post‑J.D. legal experience. For GS‑13: at least 1.5 years of post‑J.D. legal experience. For GS‑14: at least 2.5 years of post‑J.D. legal experience. For GS‑15: at least 4 years of post‑J.D. legal experience. Preferred Qualifications Experience in toxic tort litigation, including knowledge of the Federal Rules of Civil Procedure, Federal Rules of Evidence, eDiscovery, defensive litigation, and defense of important federal laws, regulations, and policies.
