Description The State of Connecticut Department of Public Health (DPH) has two openings for Staff Attorney 2 positions. Below are details for each. Position 1: Staff Attorney 2 – Administrative Prosecutor This position involves developing, negotiating, and presenting cases related to alleged violations of law by licensed healthcare and environmental professionals and entities. Specific responsibilities include reviewing complaints and triaging case files, interviewing witnesses, drafting motions and statements of charge, holding compliance conferences, preparing exhibits, negotiating consent orders, and presenting at formal administrative hearings before licensing boards and hearing officers. Position 2: Staff Attorney 2 – Regulatory Advisor This attorney will advise program leadership on health law and policy issues to promote compliance with state and federal statutes and regulations, especially in the Infectious Disease and Community and Family Health Branches. The role includes advising on the Freedom of Information Act and representing the Department in hearings before the Freedom of Information Commission. DPH accomplishes this through the implementation of its Strategic Plan, which outlines the actions it is taking to accomplish its mission. Responsibilities Perform advanced and complex legal work of an agency Research, interpret, analyze and apply complex and conflicting laws and regulations, case law, and legal principles Act as hearing officer or represent agency in formal administrative and public proceedings on a full range of cases involving complex legal and technical issues Negotiate and draft settlement agreements Draft advisory opinions, rulings, decisions, recommendations, findings, legislation, statutes, regulations, publications and other related legal documents Assist in the preparation and presentation of trials and appeals Consult with the Office of the Attorney General on legal issues Research complex legal issues Conduct investigations and enforcement proceedings Prepare comprehensive reports for use in administrative and court proceedings Prepare pleadings and other court papers Interpret and apply complex or conflicting laws and regulations, case law, and legal principles Participate in conduct of various educational activities Provide legal guidance when duly authorized Provide input into policy formation Review court decisions, new and proposed laws and regulations to determine impact on agency operations Prepare and maintain precedent manuals Review legal and other related documents for legal sufficiency May testify at or monitor legislative proceedings May represent agency in court when authorized Perform related duties as required Knowledge, Skills and Abilities Considerable knowledge of: Legal principles, practices, and procedures in Connecticut Legal research techniques The Uniform Administrative Procedures Act Relevant state and federal laws, statutes, regulations, and legislation Agency policies and procedures Knowledge of: The rules of evidence Criminal and constitutional law and legislative process Considerable interpersonal skills Oral and written communication skills Considerable ability to: Apply judicial decisions to the interpretation of statutes Comprehend, analyze and organize technical data and coordinate elements of legal cases Minimum Qualifications Two (2) years of experience in the practice of law. Preferred Qualifications Experience researching, interpreting, and applying complex statutes, regulations, and case law Experience with pretrial litigation, including reviewing discovery, drafting motions, and interviewing witnesses Experience negotiating complex settlements Experience drafting persuasive legal memoranda and briefs Experience providing legal advice to non‑legal staff Special Requirements Incumbents must be admitted to practice law in the State of Connecticut. Incumbents may be required to travel.
