FY27: Assistant General Counsel- Special Education Focus

Assistant General Counsel – Special Education Focus (FY27 Budget Pending) This position is primarily responsible for providing legal counsel and representation in special education matters, ensuring compliance with federal laws such as the Individuals with Disabilities Education Act (IDEA) and Section 504 of the Rehabilitation Act. Provide daily advice and regular training to schools and central office partners on special education law. Defend due process litigation cases. Participate in mediation. Draft settlement agreements. Review and revise special education policies, regulations, and practices. Wage range: $130,899 – $182,217. Summary Description Under general supervision of the Chief of Legal Services, this position provides high-quality legal counsel and representation for Montgomery County Public Schools (MCPS), acting as a legal adviser on a wide variety of matters, including education law, students' rights, civil rights, employment, real estate, local government, procurement, contracts, and tort law. The assistant general counsel participates and supports the legal director in litigation cases, advises stakeholders, district leaders, and MCPS employees on various legal matters, and oversees the work of legal support positions as needed. Knowledge, Skills, and Abilities Thorough knowledge of legal principles and their application; expertise in education law (including student rights), civil rights, employment law, litigation, procurement, real estate, local government, tort and contract law; excellent oral and written communication; strong legal research and presentation skills; ability to develop and maintain relationships with MCPS employees and managers, external attorneys and law firms, parents, government leaders, and community stakeholders; ability to interact with diverse constituencies and convey complex information with tact and diplomacy; multi-tasking, prioritizing, and organizational skills; attention to detail; and ability to perform under pressure and meet strict timelines. Education, Training, and Experience Possession of a Juris Doctorate degree from an accredited law school and a minimum of five (5) years of progressively responsible legal practice experience in the public or private sector, preferably involving public school legal issues. Experience in settlement resolution/negotiations and public litigation is required. Alternative combinations of education, training, and experience that provide equivalent knowledge, abilities, and skills will be considered. Certificate/Licenses: Membership in or eligibility for the Maryland State Bar. Physical Demands: None.
