Healthcare Associate Attorney
A growing Texas healthcare law firm is seeking a Healthcare Associate Attorney to work directly with physicians, nurse practitioners, dentists, behavioral health providers, and the businesses that support them.
The firm serves as outside general counsel to growing healthcare practices, assisting clients with business structuring, regulatory compliance, contracts, transactions, licensing matters, disputes, and other legal issues that arise as their organizations grow.
This is a client-facing position with direct responsibility from the start. The Healthcare Associate Attorney will independently manage matters, advise practice owners on complex healthcare regulatory and business issues, and translate legal requirements into practical solutions clients can understand and implement.
The ideal candidate will have 2-5 years of experience in healthcare regulatory, transactional, corporate, or administrative law and be comfortable managing matters with a high level of independence.
Essential Duties and Responsibilities
- Advise healthcare clients regarding the Anti-Kickback Statute, Stark Law, state fee-splitting requirements, and referral restrictions.
- Structure healthcare arrangements in accordance with applicable safe harbors and regulatory exceptions.
- Counsel clients regarding corporate practice of medicine restrictions and Management Services Organization (MSO) structures.
- Advise on HIPAA compliance, including policies, Business Associate Agreements, breach analysis, and breach response.
- Counsel healthcare providers regarding telehealth requirements, including cross-state practice, prescribing, modality, and reimbursement requirements.
- Advise on scope-of-practice, supervision, and collaborative practice agreements for advanced practice providers.
- Assist clients with professional licensing, board matters, and other regulatory requirements.
- Form and restructure professional entities, including PLLCs and professional corporations.
- Support healthcare practice acquisitions, sales, affiliations, and other transactions.
- Draft, review, and negotiate provider employment agreements and independent contractor agreements, including compensation structures.
- Assist with payer contracting and credentialing matters.
- Draft and negotiate vendor, lease, and service agreements.
- Advise clients regarding trademark and brand protection for practices, service lines, and provider brands.
- Represent healthcare providers in board investigations, licensure actions, and administrative proceedings.
- Handle payer audits, overpayment demands, and reimbursement disputes.
- Pursue and defend contractual disputes involving healthcare practices, partners, vendors, and other parties.
- Manage matters through litigation when necessary.
- Serve as the day-to-day legal contact for outside general counsel clients.
- Translate complex regulatory requirements into clear, practical guidance for healthcare business owners.
- Identify potential legal and regulatory risks early and develop practical alternatives and solutions.
- Independently manage matters from initial intake through resolution or closing.
- Maintain accurate deadlines, documentation, and client communications.
Required Qualifications
- Active license to practice law in Texas or eligibility for immediate admission.
- 2-5 years of experience in healthcare regulatory, transactional, corporate, and/or administrative law.
- Demonstrated ability to independently draft, review, and negotiate legal agreements.
- Strong legal research, analytical, and problem-solving skills.
- Ability to communicate complex legal and regulatory requirements in clear, plain language.
- Strong written communication skills with excellent attention to detail and accuracy.
- Ability to communicate directly and professionally with healthcare practice owners and other clients.
- Strong organizational and deadline-management skills.
- Ability to manage legal matters independently with appropriate attorney oversight.
- Professional, responsive, and dependable approach to client service.
Preferred Qualifications
- Experience with healthcare regulatory and compliance matters.
- Experience working with physician practices, behavioral health organizations, dentists, nurse practitioners, or allied health providers.
- Familiarity with the Texas Medical Board, Texas Board of Nursing, and Texas Health and Human Services Commission (HHSC) requirements.
- Knowledge of the Anti-Kickback Statute and Stark Law.
- Experience with corporate practice of medicine requirements.
- Experience establishing or advising Management Services Organizations (MSOs).
- Experience with healthcare practice formation and restructuring.
- Exposure to administrative proceedings, professional licensing matters, board investigations, or civil litigation.
- Experience handling healthcare transactions, acquisitions, sales, or affiliations.
- Ability to independently manage a matter from intake through closing or resolution.
Work Environment / Schedule
- Full-time position.
- Primarily remote work environment.
- Candidates must be available for occasional in-person meetings or proceedings when necessary.
- Flexible scheduling with access to the firm's Metroplex office.
- Client-facing role with direct client interaction beginning early in employment.
- Attorneys will have direct ownership of matters rather than working exclusively on individual portions of larger matters.
- Work involves regulatory, transactional, corporate, administrative, and contested healthcare matters.
