Primary Location Texas – Austin Work Locations CPD – Austin, Dallas, El Paso, Houston, San Antonio Job Title Assistant Attorney General IV Employee Status Regular Schedule / Salary State Job Code: 3513 | Salary Admin Plan: B | Grade: 28 | Monthly Salary: 10,833.34 – 11,666.67 | Overtime Status: Exempt General Description The Consumer Protection Division (CPD) seeks a licensed attorney for a highly competitive appellate position. Work involves analyzing CPD enforcement actions on appeal, drafting internal case assessments, advising leadership on litigation strategy, preparing appellate briefs and reply briefs, and presenting oral argument in Texas appellate courts. The candidate will also be comfortable handling court appearances, engaging in motion practice, and zealously litigating issues on behalf of the State. The CPD works to protect Texas consumers and the legitimate business community by investigating breaches of fiduciary duties, fraud and deceptive advertising, filing civil lawsuits to enforce state and federal consumer protection and charitable trust laws, and educating Texans on how to spot and avoid possible scams. The Division has regional offices in Austin, Dallas, El Paso, Houston, and San Antonio, and provides a highly collaborative work environment where lawyers manage their own dockets as first and second chair from the initial stages of a case through resolution. Essential Position Functions Draft appellate briefs, reply briefs, and motions in Texas appellate courts; prepare cases for oral argument. Analyze trial court records, identify preserved error, and assess appealability and likelihood of success on appeal. Provide legal advice, counsel and assistance to clients and management on appellate issues. Represent the Office of the Attorney General in oral argument before Texas Courts of Appeal and in appellate motion practice. Perform legal research and investigations; report findings and recommendations to leadership. Monitor developing appellate case law relevant to the Texas Deceptive Trade Practices Act and consumer protection enforcement; advise division on legal developments. Coordinate with trial counsel on preservation of error, development of appellate records, and appellate strategy. Prepare legal documents, including briefs, pleadings, and memoranda; prepare cases for trial. Provide technical guidance and mentorship to less experienced attorneys on appellate practice and brief writing. Maintain knowledge of appellate procedure, standards of review, and legal principles relevant to Consumer Protection. Maintain a high volume of appellate cases and trial court support matters. Perform related work as assigned. Maintain relevant knowledge necessary to perform essential job functions. Attend work regularly in compliance with agreed-upon work schedule. Ensure security and confidentiality of sensitive and/or protected information. Comply with all agency policies and procedures, including those pertaining to ethics and integrity. Minimum Qualifications Graduated from an accredited law school with a J.D. Five years of full-time experience as a licensed attorney in civil litigation. Authored at least five appellate briefs in state or federal courts. Presented oral argument before a Texas appellate court. Licensed as an attorney by the State of Texas. Member in good standing with the State Bar of Texas and eligible to practice law in Texas by start date. Knowledge of the Texas Deceptive Trade Practices Act and relevant Consumer Protection Statutes. Ability to handle multiple tasks, prioritize, and meet deadlines. Effectiveness in oral and written communication. Sound judgment and effective decision making. Legal research, writing, and analysis skills; conduct investigations; mediation and negotiations; reasoning and logic; solving complex problems; judgment to identify courses of action; and use of a computer and applicable software. Computer skills for word-processing and data entry/retrieval. Ability to prepare legal documents, conduct research, interpret and apply laws, summarize findings, prepare cases, present at trial, conduct hearings, communicate effectively, and train others. Work under pressure and respond to deadlines. Supervise the work of others. Receive and respond positively to constructive feedback. Work cooperatively with others in a professional office environment. Provide excellent customer service. Work in person at assigned OAG work location; perform all tasks at designated OAG workspace; collaborate, train, and mentor coworkers during each work week (unless on approved leave). Arrange personal transportation for business-related travel. Work more than 40 hours as needed and in compliance with the FLSA. Lift and relocate 30 lbs. Travel (including overnight travel) up to 20% of the time. Preferred Qualifications Experience with the Texas Deceptive Trade Practices Act or consumer protection enforcement.
