BWC’s core hours of operation are Monday-Friday from 8:00am to 5:00pm, however, daily start/end times may vary based on operational need across BWC departments. Most positions perform work on-site at one of BWC’s seven offices across the state. BWC offers flex-time work schedules that allow an employee to start the day as early as 7:00am or as late as 8:30am. Flex-time schedules are based on operational need and require supervisor approval. What You’ll Be Doing Plans, directs, and coordinates non‑judicial administrative settlements in assigned territory (e.g., negotiates and approves settlement amounts that exceed the agency limit of the BWC Attorney 2). Develops & implements settlement strategies to maximize savings for BWC based on type of claim and meets with legal representatives and/or executive level managers of public and private employers and attorney representatives of injured workers to negotiate settlement options and procedures. Reviews settlement filings, determines savings to BWC from claims reserve funds, prepares legal briefs for settlements, researches Ohio Revised Code, and represents the BWC Administrator at legal proceedings in cases where settlements cannot be agreed to. Reviews complaints for potential legal violations, researches current BWC legislation, writes draft legislation to expand BWC settlement options, and answers legal inquiries from government officials and/or public. Participates in the revision and drafting of BWC policy on settlements and provides a legal opinion on BWC policy and procedure related to Medicare secondary payer, Medicare set asides, and Medicare conditional payments. Handles duties related to the BWC Board of Directors, including attending Board of Directors meetings, handling scribe duties and takes minutes on behalf of BWC Board of Directors, note taking, assembling all needed documentation and motions, handling business and procedural operations related to the Board of Directors, and addressing all other incidental operations related to the Board of Directors. Trains settlement personnel, represents the BWC Administrator at meetings and seminars to discuss BWC settlement policy, consults with Office of Ohio Attorney General, and acts as a "referee" in R.C. 119 health partnership program decertification hearings and public employer review panel hearings. Qualifications Admission to Ohio Bar per Section 4705.01 of Revised Code; 2 yrs. exp. as licensed attorney practicing workers' compensation law; 6 mos. trg. or 6 mos. exp. in supervisory principles & techniques, management or settlement negotiations; must be able to provide own transportation. Or 18 mos. exp. as BWC Attorney 1, 63981; must be able to provide own transportation. Or 12 mos. exp. as BWC Attorney 2, 63982; must be able to provide own transportation. Or equivalent of Minimum Class Qualifications For Employment noted above may be substituted for the experience required, but not for the mandated licensure.
