We are seeking a motivated Workers' Compensation Attorney to represent injured workers in all aspects of workers' compensation claims. The attorney will evaluate incoming cases, provide clear legal counsel to clients, develop litigation strategies, pursue hearings and appeals, and negotiate settlements aimed at securing maximum benefits. The ideal candidate combines strong litigation skills with empathy for clients and a thorough knowledge of workers' compensation law.

Key Responsibilities

• Manage a caseload of claimant-side workers' compensation matters from intake through resolution, including drafting and filing petitions, pleadings, and motions.
• Conduct thorough case evaluations and legal research to develop litigation strategies and advise clients on case options and likely outcomes.
• Prepare for and represent clients at hearings, mediations, depositions, and appeals before workers' compensation boards and administrative tribunals.
• Negotiate settlements with carriers, defense counsel, and third parties to achieve fair compensation for medical benefits, wage loss, permanent disability, and related claims.
• Gather and review medical records, vocational evaluations, wage documentation, and other evidence; coordinate with treating physicians, experts, and investigators as needed.
• Manage discovery, respond to discovery requests, and prepare witnesses and exhibits for hearings and trial.
• Communicate regularly and clearly with clients, keeping them informed of case status, deadlines, and strategic decisions; maintain compassionate client relationships.
• Maintain accurate case files, meet filing deadlines, track statute of limitations, and ensure compliance with court and administrative procedures.
• Collaborate with colleagues, paralegals, and support staff to streamline processes, improve case outcomes, and meet firm productivity targets.
• Participate in client development activities, community outreach, and continuing legal education to stay current on regulatory and statutory changes affecting workers' compensation law.

Qualifications

• Juris Doctor (JD) degree from an accredited law school.
• Admission to the NY bar and in good standing
• 2+ years of experience handling claimant/plaintiff workers' compensation matters preferred; litigation experience strongly preferred.
• Proven experience with workers' compensation processes, including petitions, hearings, appeals, and settlement negotiations.
• Demonstrated courtroom and administrative hearing experience; comfort with depositions, witness preparation, and presenting evidence.
• Strong legal research and writing skills, with the ability to draft persuasive pleadings and settlement demands.
• Excellent client-service skills, including clear oral communication, empathy, and the ability to explain complex legal issues to nonlawyers.
• Effective negotiation skills and a track record of achieving favorable settlements or verdicts for plaintiffs.
