The Alcoholic Beverages and Tobacco legal unit (ABT Legal) provides legal services and representation to the Division of Alcoholic Beverages and Tobacco within DBPR. This section prosecutes and defends administrative actions before the Division of Administrative Hearings (DOAH) and the state’s circuit courts. This section also provides legal advice, drafts legal opinions, declaratory statements, variance and waivers, assists in rulemaking, and provides bill analysis.
The Work You Will Do:
The Attorney Supervisor position is responsible for oversight of attorney caseloads and workload assignments within the Office of the General Counsel related to the Division of Alcoholic Beverages and Tobacco (ABT). The Attorney Supervisor works under the direction and supervision of the Chief Legal Counsel and General Counsel and with minimal guidance.
Your Specific Responsibilities:
- Provides guidance to attorneys within the ABT Legal;
- Performs all required tasks related to supervision of employees including attendance and leave approvals, employee evaluations, recruitment and selection, employee development, and employee support and motivation and other supervisory related duties;
- Researches, prepares, negotiates, and prosecutes various complex actions involving formal and informal proceedings available under Chapter 120, Florida Statutes;
- Develops a specialized knowledge in laws and regulations pertaining to alcoholic beverages and tobacco industries and provides legal support pertaining to quota licenses, foreclosures, and lien issues;
- Works closely with appellate attorney to prepare and at times present appellate cases regarding alcoholic beverages and tobacco;
- Provides legal counsel to the Division of Alcoholic Beverages and Tobacco's director, bureau chiefs, and section heads regarding program implementation, formulating policy, responding to consumers, licensees, complaints, and legislative inquiries;
- Provides written and oral legal opinions, administrative rules and legislative recommendations related to the alcoholic beverage and tobacco industry;
- Prepares emergency orders of closure on licensed establishments who represent a threat to the health, safety and welfare to the State of Florida and its citizens;
- Guides operation of ABT Legal strategic plans and coordinates appropriately with internal and external partners.

Minimum Requirements :
- Membership in good standing with The Florida Bar; and
- At least two years of experience in the practice of law; and
- Valid Driver's License.
Preferred :
Preference will be given to those who have experience in the practice of law, legal proceedings, teaching law and administrative or judicial proceedings and possess knowledge of Chapters 120, 210, 561, 562, 563, 565, 567, 568, 569, Florida Statutes.
