Workers Comp Attorney (Defense) Workers' Compensation Defense Attorney

Position Overview
We are seeking a skilled Workers' Compensation Defense Attorney to represent employers and insurance carriers in contested workers' compensation matters. The successful candidate will manage a docket of defense claims, develop case strategies, appear at hearings and mediations, and provide clear, practical legal advice to clients. This role emphasizes litigation and client advocacy to achieve efficient, favorable outcomes while maintaining compliance with statutory and ethical obligations.

Key Responsibilities
  • Represent employers and insurance carriers in workers' compensation claims, hearings, depositions, mediations, and trials.
  • Draft and file pleadings, motions, discovery requests and responses, legal memoranda, settlement agreements, and other litigation documents.
  • Develop and implement case strategies to manage risk and pursue favorable resolutions, including settlement negotiations when appropriate.
  • Conduct factual and legal research, evaluate medical records and expert reports, and prepare witnesses and experts for hearings and testimony.
  • Communicate regularly with clients to provide case updates, explain legal options, and recommend cost-effective strategies.
  • Manage a high-volume caseload, maintain accurate case files, and meet court and statutory deadlines.
  • Coordinate and supervise paralegals, legal assistants, and outside vendors (e.g., expert witnesses, investigators).
  • Collaborate with claims adjusters and in-house counsel to align litigation strategy with business objectives.
  • Maintain detailed billing, timekeeping, and active file documentation in accordance with firm and client standards.
  • Keep current with changes to workers' compensation statutes, case law, and industry trends and participate in continuing legal education.
Qualifications
  • Juris Doctor (JD) from an accredited law school and active membership in the state bar.
  • 3+ years of litigation experience with a focus on workers' compensation defense; insurance defense experience preferred.
  • Proven experience handling contested hearings, depositions, discovery, and motion practice in workers' compensation matters.
  • Strong legal research, writing, and oral advocacy skills with a record of courtroom presence and negotiation success.
  • Ability to manage a heavy caseload, prioritize tasks, and meet statutory and court deadlines.
  • Excellent client service skills, including the ability to explain complex legal issues in practical terms.
  • Experience supervising paralegals and coordinating with claims professionals and expert witnesses.
  • Familiarity with state workers' compensation statutes, rules of evidence, and administrative hearing procedures.
  • Valid drivers license and willingness to travel to hearings and client sites as needed.
  • Preferred: bilingual proficiency and familiarity with case management and billing software (e.g., CLIO, MyCase, or firm-specific systems).
