Role Overview The West Virginia State Tax Division is seeking a full‑performance level attorney (“Attorney 2”) to join its legal team. The attorney will provide legal advice and representation on behalf of the agency, including representation before the West Virginia Office of Tax Appeals for taxpayer petitions for refund and reassessment, and in matters related to property tax valuations. Responsibilities Conduct extensive legal research and respond to requests for information from taxpayers and other government entities. Draft letter rulings and other written responses to government agencies, professional organizations, and external entities on tax requirements. Provide guidance on the taxability of goods and services and evaluate the impact of proposed economic development projects and tax code changes. Assist in drafting legislation and rules, and review, analyze, and comment on proposed legislation and regulations. Represent the agency in administrative hearings and appellate courts, including litigation when assigned more complex matters. Perform related work as required and travel intermittently; a valid driver’s license is required. Qualifications Admission to the West Virginia State Bar. Two years of full‑time (or equivalent part‑time) paid employment in the practice of law. One year of full‑time (or equivalent part‑time) paid experience as an attorney with the agency is considered equivalent to two years of experience. Employment Requirements Employment requires a fingerprint‑based criminal‑background check and a tax compliance check, which will be conducted at the West Virginia Tax Division’s expense.
