This position will be filled at $2,909.36 bi-weekly and is non-negotiable.
The Hearing Officer (HO) will conduct fair hearings in a manner consistent with the efficient and effective operation of this position.
This position is expected to apply and interpret hearing procedures and the Agency's program policies for complex case situations.
The HO position researches, reviews, analyzes and maintains an up-to-date knowledge of the various programs, including pertinent statutes, court decisions, Florida Administrative Rules, federal regulations and the department's interpretation of such authorities.
LEGAL OPINIONS: The HO will respond to oral and written request for legal opinions made by the Chief Legal Counsel (Chief) and General Counsel (GC). The legal opinions should specifically address and answer the questions raised and be based on careful research, discussions with all persons having relevant information, and an exploration of underlying relevant facts.
PREVENTATIVE LAW: The HO will seek out and identify potential legal problems for the Agency for Health Care Administration (AHCA). Present identified problems along with any proposed legal advice to the Chief and GC. This should be accomplished by participating in an agency consultant role to office personnel and groups, reviewing documents, rules, manuals, and proposed and existing legislation.
LEGISLATION: The HO will work with AHCA personnel in developing legislation, reviewing proposed legislation from any source, implementing new legislation, and reviewing existing statutes for the purpose of proposing any needed remedial legislation.
RULE REVIEW: The HO will review proposed rules for both substantive and technical legality and participate in rule development, rule workshops, and rule hearings relevant to the MFHS.
LETTER, DOCUMENT AND POLICY REVIEW: The HO will review letters, documents and policies for legal sufficiency.
GENERAL INQUIRIES BY THE PUBLIC, AGENCY PERSONNEL AND OTHER GOVERNMENT PERSONNEL: When appropriate, respond to general inquiries by the public and other agencies and insure that questions are answered as fully as possible in a professional manner.
Follow Chief and GC’s instructions and handle special projects assigned by the Chief and GC in a timely and professionally competent manner.

MINIMUM QUALIFICATIONS REQUIREMENTS
Two years of professional experience in the practice of law, legal research, teaching law, or in administrative or judicial hearings.
Prior Hearing Officer experience and knowledge of Fair Hearings process is preferred.
LICENSURE, CERTIFICATION, OR REGISTRATION REQUIREMENTS
Florida Bar license in good standing
