Construction Attorney

Construction AttorneyPosition OverviewWe are seeking a skilled Construction Attorney to provide practical, strategic legal counsel and representation to clients in the construction industry. The attorney will handle a broad range of matters including contract drafting and negotiation, construction disputes, liens and bond claims, insurance and surety issues, commercial litigation, and labor and employment matters affecting construction employers and projects. The ideal candidate combines deep construction law knowledge with litigation experience and an ability to manage client relationships and business outcomes.Key ResponsibilitiesAdvise clients on construction contracts, risk allocation, payment provisions, change orders, and subcontractor agreements.Draft, review, and negotiate construction-related contracts, subcontractor agreements, and settlement documents.Represent clients in construction disputes, including payment disputes, mechanics liens, bond claims, delay and impact claims, defective work claims, and defect remediation matters.Manage and litigate matters in state and federal courts and before arbitration panels and administrative tribunals; prepare pleadings, discovery, motions, and trial/arbitration exhibits.Provide counsel on labor and employment issues affecting construction employers, including wage and hour, OSHA and safety compliance, employment agreements, discrimination and harassment claims, and union/collective bargaining issues.Conduct internal investigations, advise on employment policies and workforce reductions, and defend against employment litigation and administrative claims.Work with insurance carriers and sureties on coverage disputes and bond claims; coordinate with experts (engineers, estimators) to develop technical case positions.Counsel clients on risk mitigation, compliance, project administration best practices, and proactive dispute avoidance strategies.Manage caseload, client communications, billing and matter budgets; collaborate with colleagues and mentors to develop practice capabilities and business development initiatives.QualificationsJuris Doctor (JD) from an accredited law school and active admission to the state bar where the attorney will practice.Minimum 4-6 years of substantive experience in construction law and construction litigation, including experience with payment claims, liens, and surety matters.Demonstrated experience in employment law and employment litigation as applied to construction employers is highly desirable (wage and hour, OSHA, discrimination, unemployment, union issues).Strong trial and arbitration experience with a track record of managing cases from inception through resolution.Excellent legal research, writing, negotiation, and oral advocacy skills; ability to distill complex technical issues for clients and tribunals.Experience working with technical experts (engineers, schedulers, estimators) and translating technical evidence into persuasive legal strategies.Ability to provide practical, business-focused advice, prioritize multiple matters, and manage client relationships and billing practices effectively.Membership in professional organizations and a history of business development or client origination is a plus.High ethical standards, sound judgment, and a collaborative mindset; proficiency with case management and e-discovery tools.
