\nWe are a growing, technology-driven collection agency seeking an experienced Collections Attorney to join our in-house legal team.
\nThis is a high-impact opportunity for an attorney who wants to take ownership of a meaningful litigation portfolio and play a key role in shaping the company’s legal strategy. The position combines creditor-side litigation and judgment enforcement with defense of consumer claims involving the FDCPA, FCRA, state consumer protection laws, and related regulations .
\nYou will work closely with executive leadership, compliance, and operations while independently managing litigation across multiple jurisdictions.
About the Role\nThe Collections Attorney will serve as a central legal resource for the company, managing both affirmative creditor litigation and defensive consumer litigation.
\nOn the creditor side, you will evaluate accounts for legal action, prosecute collection lawsuits, obtain judgments, and pursue post-judgment remedies.
\nOn the defense side, you will lead the company’s response to consumer lawsuits and claims, develop litigation strategy, manage discovery and motion practice, negotiate settlements when appropriate, and coordinate with outside counsel when necessary.
\nThis position is ideal for an experienced litigator who understands the collection and consumer finance industries and is comfortable managing a substantial, multi-state docket with a high degree of independence.
Key ResponsibilitiesCreditor -Side Litigation\n- \n
- Manage and prosecute collection lawsuits in California, Washington, Oregon, Texas, and other jurisdictions as the company expands its legal program. \n
- Handle all phases of litigation, including case evaluation, pleadings, discovery, motion practice, hearings, settlement negotiations, and trial. \n
- Obtain judgments and oversee post-judgment enforcement, including wage garnishments, bank levies, liens, and other available remedies. \n
- Evaluate accounts for litigation viability, collectability, documentation, statute-of-limitations issues, and anticipated return. \n
- Partner with internal collection teams to identify accounts appropriate for legal placement. \n
- Develop scalable litigation strategies and procedures as the company expands its creditor-rights program. \n
- \n
- Defend the company against consumer lawsuits and claims involving the Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), state collection laws, and other consumer protection statutes and regulations . \n
- Analyze complaints and demand letters, assess exposure, and develop litigation and settlement strategies in coordination with company leadership. \n
- Draft answers, motions to dismiss, motions for summary judgment, discovery responses, briefs, and other litigation filings. \n
- Conduct and defend depositions and manage written discovery. \n
- Represent the company in hearings, mediations, settlement conferences, and trials as appropriate. \n
- Negotiate favorable resolutions when settlement is in the company’s best interest. \n
- Select, supervise, and manage outside counsel when local counsel or specialized expertise is required. \n
- Identify litigation trends and recommend operational changes that reduce future legal exposure. \n

- Advise executive leadership, compliance, and operations teams regarding federal and state debt collection requirements. \n
- Provide guidance regarding the FDCPA, FCRA, CFPB regulations, state collection agency statutes, credit reporting, communications practices, and litigation procedures. \n
- Review collection letters, notices, scripts, policies, workflows, and procedures for legal compliance. \n
- Assist in developing policies designed to reduce litigation and regulatory risk while maintaining effective collection operations. \n
- Provide practical training and guidance to collection and management teams. \n
- Monitor significant legal and regulatory developments affecting the accounts receivable management and consumer finance industries. \n
- \n
- Juris Doctor (J.D.) from an accredited law school. \n
- Active and in-good-standing bar membership in at least one relevant jurisdiction. \n
- Licensed in Texas, California, or Washington , and willing and eligible to obtain additional licenses as needed. Company will pay for licensing fees. \n
- Federal court experience and ability to obtain admission to applicable U.S. District Courts. \n
- Minimum 4 years of litigation experience , preferably involving collections, creditor rights, consumer finance, financial services, evictions or debtor-creditor law. \n
- Demonstrated experience handling consumer claims involving the FDCPA, FCRA, or related consumer protection statutes. \n
- Experience prosecuting creditor collection actions and/or enforcing judgments. \n
- Strong litigation, legal research, writing, negotiation, and oral advocacy skills. \n
- Ability to independently manage a high-volume, multi-jurisdiction litigation docket. \n
- Strong judgment and the ability to balance legal risk with practical business considerations. \n
- \n
- Prior experience with a collection law firm, creditor-rights practice, collection agency, financial institution, or consumer finance company. \n
- Significant experience defending FDCPA and FCRA litigation. \n
- Experience with class-action or complex consumer litigation. \n
- Familiarity with the California Rosenthal Fair Debt Collection Practices Act, Washington Collection Agency Act, Oregon collection laws, Texas debt collection laws, and similar state statutes . \n
- Experience with judgment enforcement, garnishments, levies, liens, and post-judgment discovery. \n
- Familiarity with collection agency technology, litigation management systems, or case management platforms. \n
- Existing experience practicing in Arizona, Texas, California, Washington, and Oregon is highly desirable. \n
This is more than a traditional staff attorney position. You will have the opportunity to help build and shape an expanding in-house legal operation, directly influence litigation and compliance strategy, and work closely with company leadership.
