Hearing Officer 1 (Administrative Law Judge) / Assistant Hearing Officer / Assistant Attorney 2

Duties Description The NYSOH Appeals Unit is a unit of Hearing Officers who have jurisdiction to hear appeals from NY State of Health (Marketplace) applicants and enrollees involving eligibility and enrollment in Marketplace programs. As an appeals adjudicator for the NY State of Health (Marketplace), the incumbent will be responsible for conducting hearings arising from appeals of eligibility determinations for health insurance and financial assistance. The incumbent will also conduct legal research and draft decisions and dismissals resulting from those hearings. They will also be responsible for other projects as assigned. Minimum Qualifications This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). HELPS Program titles may be filled via a noncompetitive appointment. Employees hired under NY HELPS are expected to achieve permanent competitive status within one year of permanent appointment. Uniform admission to the New York State Bar and required legal experience apply. Non-Competitive Minimum Qualifications (HELPS) Hearing Officer 1 (Administrative Law Judge), Grade 25 ($96,336): Admission to the NYS Bar and 24 months of satisfactory legal experience in trial or quasi-judicial proceedings before a governmental department or agency. Assistant Hearing Officer, Grade NS (equated to SG22, $82,326): Admission to the NYS Bar and one year of legal experience in trial or quasi-judicial proceedings before a governmental department or agency. Assistant Attorney 2, Grade NS (equated to SG20, $74,193): Admission to the NYS Bar. NOTE: Admission to the New York State Bar and current registration to practice law in New York State is required for continued employment. Disbarment or loss of registration will result in termination or suspension of employment. Preferred Qualifications Candidate experience working as counsel for public health insurance programs and/or with a legal services organization specializing in health law, combined with experience in administrative law hearings.
