Position Overview
We are seeking an experienced Intellectual Property Litigation Attorney to join our team. The attorney will handle IP litigation matters across industries including pharmaceuticals, technology, software, and electronics. Responsibilities include counseling clients on IP strategy, litigating patents and trademarks, managing PTAB and ITC proceedings, and leading Hatch-Waxman (ANDA) matters. The role requires a pragmatic litigator and counselor who can protect and enforce clients IP rights and support business objectives.

Key Responsibilities

• Advise clients on IP strategy, portfolio management, and freedom-to-operate analyses across pharma, technology, software, and electronics sectors.
• Lead and support patent litigation in federal courts, ITC investigations, and district court cases; manage trial preparation, discovery, motions, and hearings.
• Handle PTAB proceedings including IPRs, PGRs, and CBM petitions and responses; develop strategy for petitions, settlements, and appeals.
• Manage Hatch-Waxman/ANDA litigation and related pharmaceutical regulatory disputes, including Paragraph IV litigation and coordination with regulatory counsel.
• Draft and respond to cease-and-desist letters, licensing agreements, settlement agreements, and other transactional documents relating to IP.
• Conduct validity, infringement, and patentability analyses and prepare expert reports and declarations.
• Provide comprehensive due diligence for M&A, licensing, and investment transactions involving IP assets.
• Collaborate closely with inventors, engineers, scientists, and business teams to translate technical concepts into strong legal positions and prosecution strategies.
• Supervise and mentor junior attorneys, patent agents, and paralegals; manage case budgets, outside counsel, and docketing to meet client and firm objectives.
• Develop and maintain client relationships and support business development, including preparing client presentations and contributing to proposal work.

Qualifications

• Juris Doctor (JD) degree from an accredited law school and admission to practice in at least one U.S. state.
• Registration with the USPTO preferred
• 2+ years of experience in IP litigation; greater experience in PTAB, ITC, or Hatch-Waxman matters strongly preferred.
• Demonstrated litigation experience in federal courts and ITC, including motion practice, discovery, depositions, and trial-level preparation.
• Experience with PTAB proceedings (IPR/PGR/CBM) and managing petition strategy and responses.
• Experience handling Hatch-Waxman/ANDA litigation and pharmaceutical patent disputes is highly desirable.
• Technical background (degree) in engineering, computer science, chemistry, biology, pharmacology, electronics, or a related technical field preferred.
• Proven experience with patents in technology areas such as software, electronics, pharma, biotech, or medical devices.
• Excellent legal research, technical writing, and oral advocacy skills; strong drafting skills for pleadings, expert reports, briefs, and licensing documents.
• Ability to manage multiple matters, prioritize deadlines, and work effectively with cross-functional teams and external counsel.
• Strong client-facing skills, business acumen, and a proactive approach to developing and retaining client relationships.
