Title: Medical Malpractice Defense Attorney

Location: Carlsbad, CA

Salary: $130k-$180k/yr DOE

Position Overview
We are seeking an experienced Medical Malpractice Defense Attorney to join our litigation team. The successful candidate will defend healthcare professionals and institutions in complex medical malpractice matters, manage all phases of litigation from intake through trial, and work closely with medical experts and clients to achieve favorable outcomes while minimizing risk and exposure.

Key Responsibilities

• Manage a diverse caseload of medical malpractice and general liability matters from case evaluation through resolution, including trials when necessary.
• Conduct thorough legal research, draft pleadings, motions, discovery requests and responses, and prepare evidentiary and pretrial filings.
• Take and defend depositions, examine witnesses at trial, and lead courtroom advocacy in state and federal courts as required.
• Coordinate and consult with medical experts, life care planners, and other consultants to prepare expert reports and trial evidence.
• Provide strategic legal advice to clients, including hospitals, physicians, clinics, and healthcare professionals, on case strategy, risk management, and settlement options.
• Negotiate settlements and mediations with opposing counsel and insurance carriers to achieve cost-effective resolutions.
• Manage pre-litigation investigations, including document review, medical record analysis, and identification of potential defenses and liability issues.
• Supervise and mentor junior attorneys, paralegals, and litigation support staff; delegate tasks and oversee quality of work.
• Maintain case management systems, meet billing and documentation deadlines, and ensure compliance with court rules and firm policies.
• Participate in business development activities, client relationship management, and continuing education to stay current with changes in healthcare law and litigation trends.

Qualifications

• Juris Doctor (JD) degree from an accredited law school and admission to the state bar where practice will occur.
• Minimum of 5 years of civil litigation experience, with a strong emphasis on medical malpractice defense and general liability matters.
• Proven trial experience, including participation in jury trials and bench trials; strong courtroom presence and advocacy skills.
• Demonstrated experience working with medical experts, understanding medical terminology, and interpreting medical records.
• Excellent legal research, writing, and analytical skills; ability to draft persuasive briefs, motions, and settlement documents.
• Strong negotiation skills and experience dealing with insurance carriers and claims adjusters.
• Ability to manage multiple cases and deadlines, with strong organizational and case-management skills.
• Exceptional interpersonal and client-management skills, including the ability to explain complex legal issues to non-lawyers.
• Proficiency with litigation support and case management software; comfortable with e-discovery and electronic document review.
• Willingness to travel for depositions, hearings, mediations, and trials as needed.
