About this Unit:
The position is located within the Colorado Department of Human Services (CDHS), Behavioral Health Administration (BHA) which leads and promotes the State's behavioral health priorities, ensures that behavioral health services respond to the changing needs of communities, monitors State and local data, and continuously evaluates State efforts. In collaboration with other state agencies, the BHA is accountable for the delivery of behavioral health services in Colorado. It bestows a streamlined and efficient government approach to support quality care while minimizing the burden to providers so that they can focus on service delivery. The BHA is responsible for behavioral health policy development and effective collaboration with cross-sector partners working in and around the behavioral health system and along the continuum from prevention to treatment and recovery. The BHA works in partnership with State agencies to reduce bureaucracy and fragmentation.

This position sits within the Quality and Standards Division's Safety Net Unit within the BHA and reports directly to the Safety Net Associate Director. The Safety Net Unit is responsible for safety net design, quality and standards including policy and behavioral health licensure development, service provision and coordination, program monitoring and evaluation, and administrative oversight for the public behavioral health system (in accordance with the Expansion of the Safety Net; SB-19-222 Behavioral Health Entity Licensure; BH19-1237). The Quality and Standards Division is responsible for overseeing the survey monitoring function, regulatory and statutory compliance, adverse licensing actions, enforcement of regulations, technical assistance to internal and external stakeholders, care coordination, and developing the regulatory structure of behavioral health licensing.

About this Position:
This position requires subject matter expertise in community behavioral health systems, laws, and regulations that are needed in order to support the BHA in its overall mission. This Policy Advisor III position provides support in making interpretative decisions on how to best advocate and promote behavioral health services in Colorado. This position supports technical assistance in policy-making and legislative strategic planning as directed by leadership. The Policy Advisor III provides detailed research, analysis, and initial drafts of policy, legislation, and administrative rules that incorporate best practices, improved standards of care, and specific strategies to effectively implement behavioral health services. This position works closely with the Policy and External Affairs Division as well as the Statewide Programs, Technical Assistance, and Innovation Division within the BHA coordinating strategy, policy design, and administrative rules to enhance behavioral health quality. This position uses judgment and resourcefulness while relying on established theory and professional standards, to make expert opinions and establish how programs or systems are implemented and monitored through regulations.

Stakeholders
The position includes material development, analysis, and draft responses to external partners in support of the Safety Net Associate Director's diverse and broad stakeholder engagement in the process of policy, legislation, and rule promulgation. The position is responsible for supporting revisions and incorporation of stakeholder feedback within rapid timeframes to support the Safety Net Associate Director and Division Director in regulatory priorities and external affairs. The position is asked to coordinate policy and rule development with other state departments and divisions to support the BHA's statewide strategic vision. This may include shared drafting, coordination of policy efforts, and integrated administrative rule. The position supports the Safety Net Associate Director in supporting the State Board of Human Services review of policy and rule.

Following the passage of legislation, the position coordinates the implementation of legislation as it relates to new regulations. Similarly, this person supports the Safety Net Associate Director and others within the division to respond to requests from other Departments and stakeholders on behavioral health program implementation and Behavioral Health regulation (2-CCR 502-1 and 2 CCR 502-5). This position provides materials and technical assistance to other state Departments and public stakeholders on these regulations and policies and ensures other state Departments are represented on boards and commissions. The position demands skill and expertise in the development, evaluation, and recommendation of major regulatory and program determinations that have influence at a state level, including regulatory and program determinations that may affect multiple state Departments, such as HCPF, DPS, DORA, and CDPHE. The position is expected to support the Safety Net Associate Director in the analysis of operating policies, guidelines, and work processes inside as well as outside the administrative unit and create strategic approaches to particular circumstances.

Behavioral Health Rules Drafting and Technical Assistance :

Provide research, analysis, and synthesis of best practices on administrative and provider rules
Draft administrative and provider rules based on established theory and standards of care.
Develop training and technical assistance materials to support other state agencies, external partners, and internal BHA personnel with interpretation, interpretation, and implementation of administrative rules.
Support monitoring of compliance with administrative rules as directed by the Safety Net Associate Director.
Support the development of materials for Board Packets and any research or additional materials to support justification for Safety Net Associate Director presentations to the State Board.
Create briefs on how administrative rule affects the BHA, other state Departments, and other community partners.
Makes revisions to rules based on feedback from the Board and ensures that content expertise is present as needed.
Support maintenance of the calendar of rule review and revision for the BHA, scheduling and managing material development for stakeholder feedback, preparing rule packages, summarizing committee reviews and clearance processes, and ensuring all public notice requirements are met.
Coordinate with the State Board of Human Services Administrator to ensure rule packet completions and coordinate scheduling with the State Board of Human Services.
Seeks out content expertise both within and outside the BHA and drafting rules to satisfy a variety of stakeholders and best practices.
Develop routine meetings and processes for working with other state agencies on administrative rule development to support integrated and consistent rules across agencies on core topics for BH across the agency.
Review statutes to ascertain legislative intent and prepare materials for the Safety Net Associate Director's interpretation of intent in rule, seeking consultation from the Office of the Attorney General as needed.
Ensures that rules are aligned with other state Departments, including CDPHE licensing rule and DORA scope of practice rule.
Provide training for stakeholders and BHA staff in statutory provisions affecting BHA.
Draft response to questions from the State Board of Human Services on the rationale and content of the rule.

Legislative, policy and rule review, analysis, and research :

Coordinate feedback across all BHA Divisions, Other state Departments on the Department's fiscal and policy analysis of new legislation. Provide research, analysis, and draft recommendations to the Safety Net Associate Director.
Provide research, analysis, and drafting of statutory and regulatory changes, policies and procedures, and functions.
Support the Safety Net Associate Director with analysis of how new programs or changes to programs may impact regulations, policies, or legislation.
Support BHA divisions and other state agency personnel to understand the impact of legislation, regulation, and administrative rule.
Answer questions and provide technical assistance on statutory and regulatory changes, policies procedures and rules. This position uses judgment and resourcefulness to interpret policy and how other programs may implement the BHA's regulations, policies, and/or recommendations.
Support consultation on contractor and agency compliance with rules.
Completes draft compliance and licensing reviews and technical assistance as needed to both internal and external partners.
Review, research, and draft summaries of federal and state laws and regulations, including laws and regulations in other states, and advise the Safety Net Associate Director on implications and potential opportunities to enhance Colorado's behavioral health system.
Provides interpretation and complex analysis of statutory, regulatory, and policy impacts. Interprets and disseminates information.
Tracks completion of legislative reports ensuring adequate time for editing and clearance.
At the end of each legislative session, draft a work plan, assignments, deadlines, and deliverables to meet newly created statutory directives related to the rule for the Safety Net Associate Director.
Identify relevant statutes and regulations that may support or limit a BHA initiative.
This position's unique level of knowledge and expertise in community behavioral health systems, laws, and regulations is utilized to edit and format legislative reports to ensure they meet statutory requirements and align with the BHA's mission and goals.

Minimum Qualifications, Substitutions, Conditions of Employment & Appeal Rights

Six (6) years of experience in public or legislative policy, and/or complex regulatory experience. OR Six (6) years of experience working in behavioral health services. Any combination of this experience will also qualify.

Appropriate education will substitute for the required experience on a year-for-year basis
