About the Department The District Attorney's Office is responsible for the prosecution of all crimes or offenses that occur within the County. The office represents the People of the State of California in criminal cases, provides support and assistance to crime victims, and works in partnership with local law enforcement agencies to promote public safety. Our mission is to JUSTICE WITH INTEGRITY. The office consists of approximately 163 employees. This recruitment is to fill general criminal prosecutor positions and may result in the creation of an eligibility list for current and future vacancies. About the Position The Stanislaus County District Attorney is seeking qualified candidates for the position of Deputy District Attorney I‑V. The incumbent may be assigned to a variety of cases including driving under the influence, domestic violence, drug sales and possession, elder abuse, child abuse, gang crimes, consumer fraud, environmental crimes, agricultural crimes, auto theft, homicide, sexual assault, human trafficking, and more. Responsibilities include preparing and prosecuting cases with a team of investigators, victim advocates, paralegals, and clerical support staff; interviewing witnesses; evaluating and presenting evidence; drafting legal opinions; and performing other duties as required. Responsibilities Review investigative reports and evidence submitted by law enforcement. Issue criminal complaints. Prepare and present criminal cases in court. Draft legal opinions on points of criminal law for argument in court or for dissemination to law enforcement agencies. Perform related duties as required by the Chief Deputy District Attorney. Compensation and Benefits Bi‑weekly payroll system 5‑step salary range (5% intervals) Health insurance Paid sick leave Life – employer paid $50,000 in term life insurance Disability – long term disability insurance Vacation accrued bi‑weekly plus 12 paid holidays $900 professional development expense reimbursement Paid professional leave up to 60 hours per year CDAA dues paid by employer Bar dues paid by employer Malpractice indemnification provided MCLE in‑house training 5% certificate pay for qualifying members for Level III through V 2.5% Lead pay after qualifying to handle homicide cases 3.5% Complex Litigation certificate pay 2.5% bilingual pay of qualifying members StanCera – employer/employee paid retirement system (1937 Retirement Act) Attorney Levels Attorney I Handle routine misdemeanor matters. Attorney II Handle all misdemeanor matters, including trials and juvenile matters. Handle entry level felonies. Attorney III Handle felonies. Conduct preliminary hearings. Conduct trials. Handle juvenile court matters. Attorney IV Handle felony cases, including homicides. Track and document statistical data on appropriate cases. Attorney V Handle all felony cases, including capital homicides. May include responsibility for a specialized unit. Perform all levels of duties including other assigned responsibilities. Knowledge, Skills, and Abilities Technical knowledge in criminal law and procedure; rules of evidence; trial principles; oral argument; constitutional law; professional responsibility; court rules; and sentencing statutes. Public speaking, clear written and oral communication, flexibility, quick thinking, and basic computer proficiency. Ability to organize multiple tasks, prepare and present arguments, evaluate facts and evidence, apply legal principles, follow direction, communicate effectively, document actions, dress professionally, work in a team, and maintain professional respect. Experience and Licensing Requirements Pass California State Bar and possess a valid bar license. Minimum experience: Attorney I – Pass California State Bar and possess valid bar license. Attorney II – A minimum of six (6) months of experience as an Attorney I OR three (3) years of experience in the general practice of law. Attorney III – One (1) year experience as an Attorney II OR equivalent of four (4) years of general practice experience. Attorney IV – A minimum of one (1) year of criminal prosecution and trial experience as an Attorney III or equivalent OR five (5) years of experience in general practice. Attorney V – One (1) year experience as an Attorney IV or equivalent. Other Requirements Active membership in good standing in the State Bar of California at time of appointment. Possession of a valid California Driver's License. Ability to pass a thorough background investigation, including fingerprinting. Desirable Qualifications A minimum of three (3) months experience working in a District Attorney’s Office or Public Defender’s Office. Experience with misdemeanor matters, law & motion, trials, juvenile matters, felonies, preliminary hearings, and sentencing. Familiarity with “Brady” issues and “Pitchess” motions.
