Job Summary
Spector Foerst & Associates is seeking an experienced, highly organized, and compassionate Pre-Litigation Case Manager to join our personal injury team.
This position is responsible for handling personal injury cases from case inception through settlement. If a case does not resolve during the pre-litigation phase, it is transitioned to the litigation team. The Pre-Litigation Case Manager is not responsible for litigating the case after suit is filed, but is expected to prepare the file for a smooth transition when necessary.
The ideal candidate is someone who thrives in a fast-paced legal environment, communicates clearly with clients and attorneys, and understands that injured clients are often going through one of the most difficult periods of their lives. We are looking for someone who can provide consistent updates, compassion, structure, and accountability while helping move cases toward resolution.
Spanish fluency is required.
Key Responsibilities
Client Communication & Case Management
- Serve as the primary point of contact for clients throughout the pre-litigation process.
- Provide timely, compassionate, and professional updates to clients.
- Educate clients about the personal injury process and what to expect during each phase of their case.
- Manage client expectations regarding treatment, case progression, settlement timelines, insurance issues, and next steps.
- Maintain consistent communication with clients to ensure they remain engaged in their treatment and case.
- Document all communications, updates, and case activity in the firm’s case management software.
Medical Treatment Coordination
- Assist clients in obtaining appropriate medical treatment.
- Track each client’s medical treatment from beginning to end.
- Communicate with medical providers regarding appointments, treatment status, records, bills, and treatment plans.
- Ensure clients are following through with recommended treatment.
- Monitor gaps in treatment and address issues with clients as needed.
- Maintain organized medical records and treatment timelines.
Records, Bills & Demand Preparation
- Request, obtain, review, and organize medical records, bills, reports, and treatment summaries.
- Analyze medical documentation to understand the nature and extent of injuries.
- Prepare detailed settlement demand packages once treatment is complete.
- Draft, review, and finalize demand packages in coordination with the attorneys.
- Ensure demand packages are complete, accurate, persuasive, and supported by documentation.
- Identify any missing records, bills, reports, or documentation needed before a demand is finalized.
Insurance Communication & Claims Handling
- Communicate with insurance adjusters throughout the pre-litigation process.
- Handle communications involving bodily injury claims, PIP claims, UM/UIM claims, and related insurance issues.
- Track insurance claim status and ensure timely progression.
- Assist attorneys in initiating settlement negotiations.
- Communicate effectively with attorneys regarding settlement status, adjuster communications, liability issues, damages, and case value considerations.
Liens, Bills & Case Resolution
- Identify, verify, and track medical liens, outstanding balances, bills, and reimbursement claims.
- Assist with gathering information necessary for lien resolution.
- Coordinate with attorneys regarding liens, bills, and settlement disbursement issues.
- Ensure that all relevant medical expenses and lien issues are properly documented before settlement.
Deadlines & Litigation Transition
- Track statute of limitations deadlines and other important case deadlines.
- Ensure cases move forward in a timely manner.
- Identify cases that may require litigation if settlement is not reached.
- Prepare case files for potential transition to the litigation team.
- Coordinate with attorneys to ensure a smooth handoff when a lawsuit becomes necessary.
- Assist in drafting correspondence, settlement-related documents, and other legal documents as needed.
Required Qualifications
- Fluent in Spanish and English — required.
- Associate’s degree or Bachelor’s degree required.
- Minimum of 1+ year of personal injury pre-litigation case management experience preferred .
- Experience handling personal injury claims from intake through settlement preferred.
- Familiarity with:
- PIP claims
- UM/UIM claims
- Bodily injury claims
- Medical records and billing
- Medical lien identification and resolution
- Settlement demand preparation
- Experience communicating with insurance adjusters, medical providers, and clients.
- Proficiency with Microsoft Office Suite.
- Experience using case management software.
- Strong organizational skills and attention to detail.
- Ability to manage multiple cases, deadlines, and client issues simultaneously.
- Strong written and verbal communication skills.
- Ability to work independently while coordinating closely with attorneys and staff.
- Compassionate, patient, and client-focused approach.
