Under the general direction of the Director and Chief Deputy Director of the DMHC, independently and through subordinate staff, the incumbent is responsible for planning, organizing, managing and directing the statewide litigation activities of the DMHC's Enforcement Program. This includes statewide responsibility for the Division of Prosecution, the Division of Investigation, and the Division of Legal Administration. The incumbent attends meetings, providing enforcement-related information on the DMHC and statewide policy issues. The incumbent is responsible for policy development, strategic planning, implementation, and evaluation of the operations within the Office of Enforcement.
The Deputy Director, Office of Enforcement, serves as principal advisor and litigator to the Director and Chief Deputy Director providing alternatives and recommendations regarding the enforcement program operations. The incumbent supervises attorneys, managers and support staff in the Office of Enforcement, and may personally perform the most difficult, complex and sensitive legal work of the DMHC in connection with the enforcement of the Knox-Keene Health Care Services Plan Act of 1975 (Act) administered by or affecting the department. The incumbent serves as a member of the DMHC's executive management team.

The DMHC has locations in Downtown Sacramento and Rancho Cordova. Both locations are located close to light-rail with various amenities. The incumbent will work in a climate-controlled cubicle and/or office environment with artificial lighting.
This position may be eligible for hybrid telework. The telework schedule is permitted at the operational needs of the Department and is subject to change, consistent with the State Telework Policy and the DMHC's Telework Policy. All employees who telework are required to be California residents and maintain California residency in accordance with Government Code 14200.

Knowledge and Abilities
Applicants must demonstrate the ability to perform high administrative and policy - influencing functions effectively. Such overall ability requires possession of most of the following more specific knowledge and abilities:
(a) Knowledge of the organization and functions of California State Government including the organization and practices of the Legislature and the Executive Branch; principles, practices, and trends of public administration, organization, and management; techniques of organizing and motivating groups; program development and evaluation; methods of administrative problem solving; principles and practices of policy formulation and development; personnel management techniques; the department's or agency's equal employment opportunity objectives; and a manager's role in the equal employment opportunity program. (b) Ability to plan, organize, and direct the work of multidisciplinary professional and administrative staff; analyze administrative policies, organization, procedures, and practices; integrate the activities of a diverse program to attain common goals; gain the confidence and support of top level administrators and advise them on a wide range of administrative matters; develop cooperative working relationships with representatives of all levels of government, the public, and the Legislative and Executive Branches; analyze complex problems and recommend effective courses of action; prepare and review reports; and effectively contribute to the department's or agency's equal employment opportunity objectives.
These knowledge and abilities are expected to be obtained from the following kinds of experience with substantial participation in the formulation, operation and/or evaluation of program policies (experience may have been paid or volunteer; in State service, other government settings, or in a private organization):
CEA Level A - Responsible for broad administrative and program activities, including the execution and/or evaluation of program policies.
CEA Level B - Responsible for extensive managerial and program administration or broad program manager experience with substantial participation in the formulation, operation, and/or evaluation of program policies.
CEA Level C - Responsible for extensive highly professional influence and contributes to program, policy, and the methods to provide professional services needed to set policies, to meet the mission of the State department and often exercising technical and or professional skills that are required at this level.
Desirable Qualifications In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
The following should be addressed in the statement of qualifications: 1. Demonstrated experience planning, organizing, managing and directing staff activities in statewide litigation to include investigations, legal proceedings, appellate cases, settlements, post-trial negotiations, legal research and hearings. 2. Demonstrated experience with implementing and applying health care laws and other applicable state and federal laws, as well as statewide legal policy and precedence. Include experience in analyzing complex legal issues that involves interpreting statutes and regulations. 3. Demonstrated experience with evaluating enforcement, prosecution or litigation program operations to identify areas of improvement, review and determine cost efficiencies, and formulate and implement effective solutions. 4. Demonstrated ability to perform high-level litigation activities and policy influencing functions, which include working effectively under pressure and making high-level decisions in a fast-paced and changing environment. 5. Demonstrated ability to successfully identify and implement solutions to meet operational challenges through subordinate managers and supervisors. Examples should include strategic and innovative approaches to problem-solving and effective delegation. 6. Demonstrated experience with performing strategic planning activities and creating office-specific implementation plans to achieve the agency's mission and strategic goals. 7. Demonstrated ability developing staff knowledge, skills and abilities, including the identification of growth areas, documented development plans, providing direct feedback, and understanding of employees' career goals. 8. Demonstrated experience establishing productive and positive working relationships with staff, executive leadership, Governor's Office, the Attorney General's Office and other state department partners to achieve departmental goals and objectives.

A minimum rating of 70% must be attained in the Examination to obtain list eligibility for this position. All candidates will receive written notification of their examination results.
