Forty two depositions on your files last year, and a partner took most of them.

If that ratio sounds familiar, you already know the problem. You did the record review, you built the chronology, you prepped the expert, and then you sat in the second chair taking notes while someone else asked the questions you wrote. It's a very common way to spend your third, fourth and fifth years in medical malpractice defense, and it's a very slow way to become a trial lawyer.

I'm Ryan Jaiswal at Distinct Recruitment, and I'm hiring a medical malpractice defense litigator in Miami on behalf of an insurance defense firm whose partners want associates in the room asking the questions. Not eventually. Now.

The work

• Defending physicians, hospitals, nurses and other healthcare providers from first notice of a claim through to trial

• Working up the medicine properly: records, literature, causation, standard of care

• Taking and defending your own depositions, treating physician and expert depositions included

• Reporting directly to carriers and healthcare clients, rather than through a chain of partners

• Motion practice, mediations and trial preparation on files you actually run

You'll need

• Florida Bar membership

• 2+ years of litigation experience. Med mal is ideal, but strong defense litigators from bodily injury or general liability who want to move into healthcare work should still call me

• Patience with a four hundred page chart, and real curiosity about the medicine behind it

How the week runs

• Hybrid, working from the Miami office part of the week

• 1,950 billable hours a year

The pay

• $125,000 to $200,000, a deliberately wide band so a 2nd year and a seasoned counsel both land in the right place

• There's no upper limit on experience, and I'll tell you honestly where I think you'd sit in that range before you apply

Why it's worth your time

Medical malpractice is one of the few areas of insurance defense where the files get deeper rather than just more numerous. Expert heavy cases teach you to cross examine properly, to explain complicated ideas to a jury in plain English, and to earn a carrier's trust on files where the stakes are real. The lawyers who get those reps early are the ones clients ask for by name later. This firm hands them out early.
